Create/replace hard surface within the curtilage of the house*

* N.B. This applies to works for any purpose incidental to enjoyment of the house, which includes keeping of poultry, bees, pet animals, birds or other livestock for the domestic needs or personal enjoyment of occupants.

You do not need planning permission, provided that where the hard surface is situated on land between a wall forming the principal elevation of the house and a highway and area of ground covered by hard surface or area of replaced hard surface exceeds 5 square metres, the hard surface must be of porous materials or run-off water must be directed to a permeable or porous area or surface within the curtilage of the house
