Noise and Statutory Nuisance Noise and Statutory NuisanceBy its very nature, noise is often unpredictable and can occur at any time of the day and night. Investigations to establish statutory nuisance is resource intensive and the Council has recently invested in updated automatic noise monitoring equipment to assist in the investigation of such complaints. In many cases complaints are often found to be a symptom of a deeper underlying conflict between neighbours and in these cases resolution of the conflict can be difficult.The Unit will however be investigating the possibility of utilising a mediation service provision of which would be subject to the availability of the necessary resources. What to do firstWhere possible, we ask complainants to attempt to resolve problems before contacting this department. In many of the complaints that we receive, the person creating the nuisance is unaware of the problem. Register a ComplaintIf you are unable to resolve this matter personally, the next course of action is to record the details of the nuisance on a log sheet. We will send you this sheet as a matter of course upon receipt of your complaint. Once the sheet contains details of around two to three weeks worth of data, please return the sheet for our assessment. In the case of noise nuisances it will be necessary for a member of this department to witness the nuisance personally, or by carrying out recorded noise monitoring. Once the complaint is founded, this department can serve formal notice to alleviate the problem. Please note that anonymous complaints will be investigated as far as the information given or available will allow.
