Do I need Listed Building Consent?Alterations and extensions to Listed BuildingsYou need Listed Building Consent for any internal or external works to a Listed Building, affecting its character or appearance, or any object or structure fixed to the building.
Consent is also necessary for alterations, extensions etc. to any detached structure or object within the curtilage (grounds) of the Listed Building if the structure was erected before 1st July 1948. Demolition of any part of Listed BuildingsYou also need Listed Building Consent for any element of demolition of a Listed Building, including any object or structure fixed to the building, and free standing objects or structures within the grounds. Unless they are Listed in their own right, Listed Building Consent is not needed for the demolition of free-standing buildings erected within the grounds since 1st July 1948, although Conservation Area Consent may be required. The Council will not grant Listed Building Consent for substantial/total demolition/change of use, unless you have considered all practical attempts to save and refurbish the building, and can demonstrate adequately that you are unable to find a suitable alternative use. Partial demolition may also be refused unless it can be demonstrated that:-
The Council will normally only approve the demolition of a Listed Building or an unlisted building in a Conservation Area if planning permission is granted for a replacement. The Council needs to be able to assess the impact of the proposal on the special architectural or historic interest of the building and its setting, any other Listed Buildings nearby, and/or a Conservation Area. To do this we need you to tell us exactly what you wish to do, and what materials you wish to use. This includes methods of fixing, colours, wood types, etc. Time FactorsWe will make every effort to consider your application and notify you of the decision within 8 weeks, once your application is accepted as complete and valid If the proposals relate to a Grade I or Grade II* building, or involve substantial demolition of any Listed Building, we must notify the Secretary of State before the Council can grant Listed Building Consent. This notification procedure may take four to five weeks, but if the Secretary of State does not wish to 'call-in' the application (the great majority are not 'called-in'), we can then issue English Heritage have the right to record any Listed Building to be demolished for one month after any consent is granted. If this applies to your proposal a form will be included with your Decision Notice Additional InformationIf Listed Building Consent/Conservation Area Consent is refused or is granted subject to conditions that you do not agree with, you may appeal to the Secretary of State within 6 months. A Listed Building Consent/Conservation Area Consent remains valid for 5 years from the date of the Decision Notice. If you start the works within 5 years, your consent remains "live" thereafter.
