Occupational Health and Safety

Accidents

Health and Safety at work is enforced by two separate enforcing agencies. The Local Authority and the Health and Safety Executive.

If you are an employer, self-employed or in control of work premises, you are required under RIDDOR (Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995.) to report some work-related accidents, diseases and dangerous occurrences. You must report all of the following:

1. A death or major injury (e.g. fracture, amputation; dislocation, loss of sight, electric shock);
2. A member of the public is killed or taken to hospital;
3. An over three-day injury (when an employee or self-employed person has an accident at work and is unable to do their normal job for over 3 days, but does not have a major injury);
4. A work related disease;
5. A dangerous occurrence (when something happens that does not result in a reportable injury, but which clearly could have done).

Items 1. and 2. must be reported without delay. The rest should be reported within 10 days of the incident.

Accidents no longer have to be reported to the correct enforcing authority but to the RIDDOR Incident Reporting Centre.

Local Authority Control

Local Authorities are responsible for the following type of activities:

• office-based
• retail or wholesale
• warehousing
• hotel and catering
• sports and leisure
• residential accommodation (excluding nursing homes);
• places of worship
• pre-school childcare
• mobile vending

HSE is responsible for any other type of premise.
