The Health Act 2006

Information On The New Legislation

From the 1st July 2007 new legislation made under the Health Act 2006 requiring smoke-free environments in virtually all workplaces, work vehicles and public transport in England will come into force.

Essentially, the new legislation will ensure that almost all workers, regardless of their place of work, will be protected from exposure to second-hand smoke and guaranteed the right to smoke-free air. This not only affects certain public spaces such as public houses and restaurants but includes all workplaces and certain vehicles.

The legislation covers all premises, which are wholly or substantially enclosed, and used as a place of work by more than one person, e.g. all workplaces, factories pubs, offices, restaurants, cafes, etc. 'Substantially enclosed' means rooms which have a ceiling or roof, and any openings in the walls smaller than half the total area of the walls, this includes temporary or moveable structures such as marquees. The legislation will also cover vehicles which are used for work purposes, such as company cars, vans and taxis.
