Article 3 restrictions on Permitted Rights

Article 3 of the Town and Country Planning (General Permitted Development) Order 1995 specifies conditions which limit permitted development rights. These are as follows:-

1. Development involving unlawful building operations.

2. Development involving unlawful use of a building/land. 

3. Formation, laying out or material widening of access to a trunk/classified road.

4. Access to any highway used by vehicular traffic where the view of persons using the highway is obstructed thereby, so as to cause danger to such persons.

5. Development involving use contrary to an enforcement notice.

6. Development requiring an environmental impact assessment.

7. Development where there is likely to be a significant effect on the habitat of a protected species.

8. Laying/construction of a notifiable pipeline.

9. Demolition of buildings where health & safety can be secured by repair or where an owner has allowed a building to become unsafe/uninhabitable.
