Gambling Act 2005

The gambling laws in Great Britain have been updated and a new regime for commercial gambling has been introduced.  The Gambling Act 2005 comprehensively updates the gambling laws that were several decades old.  The new laws came into effect on 1st September 2007.

The Act introduces a new, unified regulator for gambling in Great Britain (The Gambling Commission) and a new regime for commercial gambling.  The new regime will be operated and regulated by the Gambling Commission or by Local Authority licensing departments, depending upon who or what is being licensed.

The new Act repeals the Betting, Gaming and Lotteries Act 1963, the Gambling Act 1968 and the Lotteries and Amusements Act 1976.

The Act has three main aims:

  • Keeping gambling crime free
  • Making sure that gambling is fair and open
  • Protecting children and vulnerable adults

The Act covers two main activities:

  • Providing facilities for gambling
  • Using premises for gambling

Social responsibility remains the top priority - protection of the public, especially children and the vulnerable.

The Local Authority Licensing Section are responsible for various types of licence application including:

  • Club gaming permits or club machine permits
  • Gaming machine permits on premises licensed to supply alcohol for consumption on the premises
  • Premises applications
  • Small lotteries registrations

Other types of application, including operators and personal licences, will be issued by the Gambling Commission.

Gambling Commission

The Gambling Commission takes over from the old Gaming Board for Great Britain in regulating gaming and certain lotteries.  It has also become responsible for regulating betting and remote gaming in Great Britain since September 2007.

The Gambling Commission will regulate all commercial gambling in Great Britain except:

  • Spread betting
    Currently regulated by the FSA
  • The National Lottery
    Regulated by the National Lottery Commission
