Temporary Event NoticesUnder the Licensing Act 2003, all temporary events including outside bars, are issued by the borough/district council. Where a premises wishes to hold the following and where they are not already licensed with either a Premises Licence or Club Premises Certificate then a Temporary Event Notice (TEN) will need to be given:
The system requires an event organiser (notice giver) to serve a Temporary Event Notice (TEN) on the local authority and send a copy to the chief officer of police for that area. Anyone aged 18 or over can give a maximum of five TENs per calendar year. Personal licence holders can give a maximum of fifty TENs per calendar year. TENs can be used to authorise relatively small-scale ad hoc events held in or on any premises involving no more than 499 people at any one time. The premises user must, no later than 10 working days prior to the event, give two copies of the notice to the relevant licensing authority, together with the fee of £21. The 10 working days must not include the day the notice is given or the first day of the event. The premises user must also give a copy of the notice to the relevant chief officer of police no later than 10 working days prior to the event (excluding the day the notice is given and the first day of the event). Each event covered by a TEN can last up to 96 hours. No more than twelve TENs can be given in respect of any particular premises in any calendar year, subject to a maximum of 15 days in any year. There must be a minimum of 24 hours between events notified by a premises user or associates of that premises user in respect of the same premises. E.g. a wife could not serve a TEN for an event if her husband held a TEN at the same premises within the last 24 hours. They could however, both serve TENs for events at different premises. Provided that the criteria set out above are met, only the police may object to or submit representations concerning an event covered by a TEN. They can only do so on the grounds of crime prevention. In this case then matter will be decided at a hearing before the Licensing Sub-Committee and if the objections are upheld a Counter Notice will be issued. However, between the police receiving the TEN and the hearing, agreement can be reached to modify the TEN in order that it meets the crime prevention objective. (NB. Because of the statutory times needed to arrange a hearing, it is important that the 10 working days notice is given.)
