Policy H24: Replacement DwellingsThe replacement of an existing dwelling with another will be allowed provided that: 1. The building is clearly recognisable as a dwelling and is not a derelict structure, and has been permanently occupied as a dwelling in recent years, 2. the building has not been intentionally abandoned or given over to any alternative use, 3. The building is incapable of sustained use as a dwelling because it cannot be satisfactorily repaired or extended, and therefore its replacement is preferable to an unsatisfactory refurbishment, 4. The proposed replacement dwelling occupies a site considered suitable by the Council, and has adequate vehicular access and an individual curtilage, and is of a design and scale appropriate to its surroundings, 5. The building is not a Listed Building or a building of vernacular interest which contributes to the quality of its surroundings. Planning permission for a replacement dwelling will normally require the demolition of the existing dwelling or the signing of a Section 106 Agreement covering its ancillary use, with a commitment not to re-apply for its re-use as a separate dwelling. 3.177 - This policy is designed to cover properties which, by virtue of their structural condition, are incapable of sustained use as dwellings. It is not intended to allow the replacement of small dwellings with large ones, nor is it a means of obtaining building plots in open countryside. Applicants who acquire a dwelling which is obviously too small to accommodate their housing needs should not expect to receive subsequent consent for its replacement with a considerably larger new one.
