Tree Preservation Orders

Tree Preservation Orders or TPOs were introduced to enable Local Planning authorities to protect important trees. The Council's adopted policy on Tree Preservation Orders can be accessed here.

TPOs can be placed on any tree that has amenity value. Trees that are exempt from TPOs are those that are dead, dying, or dangerous and fruit trees grown for the commercial production of fruit.

TPOs prohibit the cutting down, uprooting, topping, lopping, wilful damage or wilful destruction of trees without the Local Authority's consent. To apply for such consent and/or notify the Council of proposed works to trees in a conservation area, please follow the links to Online Forms at the bottom of this page.

The maximum penalty for carrying out works to TPO trees without consent is £20,000, currently.

The Council's policy is only to protect trees that are under a direct threat. A list of Tree Preservation Orders in force in the Borough is available here.

Protecterd Trees: a guide to tree preservation procedures is available here (this will take you to the external site of The Department of Communities and Local Government).

An addendum to this guide, detailing changes to the regulations which became effective from 1st. October, 2008, can be accessed by following this link to the external website of the Planning Portal.
